1. Scope of Application

These Terms of Service govern the use of the MacroYou mobile app and associated web services. They apply to all users regardless of whether they use the free or paid Premium version.

2. Service Description

MacroYou is a nutrition tracking app that enables users to:

• Track daily nutrient intake (calories, macronutrients)
• Identify and log meals using AI-powered photo recognition
• Create voice entries for quick meal logging
• Chat with a virtual coach for motivation and tips
• Track habits and training routines
• Create and share recipes and content with the community

The service is offered as a freemium model: the basic version is available for free, while advanced features are unlocked through paid monthly or yearly Premium subscriptions.

3. Account Registration

3.1 Account Creation

Users must register and create a user account to use the app. Registration requires accurate and complete information.

3.2 Age and Consent

MacroYou has no age restriction. Users under 16 require parental consent in accordance with GDPR.

3.3 Account Security

Users are responsible for password confidentiality and all account activity. Users must immediately notify LKS E-Commerce GmbH of unauthorized access.

4. Service Description

4.1 Free Basic Version

The free version includes basic features such as calorie tracking, manual food entry, and simple habit tracking.

4.2 Premium Subscription

Premium features offer advanced capabilities including AI photo recognition, unlimited voice entries, advanced analytics, enhanced coach chat, personalized recommendations, and multi-device synchronization.

4.3 Availability

LKS E-Commerce GmbH makes reasonable efforts to ensure continuous and error-free operation, but does not guarantee uninterrupted availability.

5. Pricing and Payment

5.1 Subscription Costs

Premium subscriptions are charged monthly or yearly. Current prices are available in the app and on the website. Price changes are announced in advance.

5.2 Payment Processing

Payments are processed through app store platforms (Apple App Store and Google Play Store). Users conduct payment transactions directly with these platforms, not with LKS E-Commerce GmbH.

5.3 Subscription Management and Cancellation

Users may cancel their subscription at any time through the App Store or Google Play Store. Cancellation takes effect at the next billing cycle. No refunds for previously paid fees unless legally required.

6. Usage Rights and Obligations

6.1 Intellectual Property

All content, software and materials are owned by LKS E-Commerce GmbH or its licensors. Users receive a personal, non-exclusive license to use the app in accordance with these Terms.

6.2 Prohibited Activities

Users agree NOT to: use the app for commercial purposes without permission, reverse engineer or modify the app, use automated tools, use the app illegally or maliciously, undermine security or engage in harassment.

7. User-Generated Content

User-generated content includes recipes, photos, chat messages, and habit data. By uploading content, users grant LKS E-Commerce GmbH a worldwide license to use, reproduce, and distribute this content in connection with MacroYou. Public content can be viewed and shared by other users. LKS E-Commerce GmbH reserves the right to moderate and remove content that violates these terms or is harmful.

8. Data Protection

Personal data processing is governed by our Privacy Policy. Please read our Privacy Policy to understand how we collect, use and protect your data.

9. Limitation of Liability

9.1 Not Medical Advice

MacroYou does NOT provide medical, nutritional, or sports medicine advice. Content is for informational and motivational purposes only. The coach chat is not a substitute for professional medical advice. Users should always consult a doctor or registered dietitian before making significant dietary or health changes.

9.2 AI Disclaimer

The AI-powered photo recognition may contain errors. Users should verify food suggestions and correct them manually. LKS E-Commerce GmbH is not liable for incorrect identifications.

9.3 Liability Limit

To the extent permitted by law, LKS E-Commerce GmbH is not liable for indirect, incidental, special or consequential damages, loss of data, profits or business opportunities, erroneous results, or losses caused by third parties. Our total liability is limited to the amount paid by you in the last 12 months or EUR 50, whichever is greater.

9.4 Warranty Disclaimer

The app is provided "as is" and "as available." LKS E-Commerce GmbH makes no express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement of third-party rights.

10. Termination

10.1 User Termination

Users may delete their account at any time. User-generated content will not be restored after deletion unless legally required.

10.2 Termination by LKS

LKS E-Commerce GmbH may immediately terminate or suspend a user account if the user violates these Terms, acts illegally, or abuses the platform.

11. Changes to Terms

LKS E-Commerce GmbH may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the app constitutes acceptance of new terms.

12. Final Provisions

12.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

12.2 Jurisdiction

The exclusive jurisdiction for all disputes is Wuppertal, Germany, unless mandatory law requires otherwise.

12.3 Severability

If any provision of these Terms is invalid, the remaining provisions remain in effect.

12.4 Entire Agreement

These Terms constitute the entire agreement between you and LKS E-Commerce GmbH.
